Legal advice

Legal entry

Always make sure your passport is valid.

Extend its validity at least two months before the expiration date at the relevant consulate/embassy of Tajikistan abroad.

If you have lost your passport, immediately inform the Tajik embassy/consulate about it by providing your detailed personal information, such as passport number, date and place of issue, your name and surname, as well as the date of entry into the country of destination; therefore it is so important to always keep a copy of your passport with you. Keep a copy of your passport (including electronic) in a place always accessible to you.

Extend your visa/employment contract before it expires. If you decide to return to Tajikistan on vacation, make sure that your visa does not expire before you return to your destination country.

Do not stay in the country of destination after your visa expires.

Legal employment

  • Always check the validity of your work permit or its equivalent from the country of destination.
  • Always make sure you have a valid employment contract for a specified period.
  • Follow the laws of the country where you work, even if they seem rude or unfair.

 How to protect your rights

As a migrant worker, you must be aware of the potential cases of abuse and exploitation. If there are signs of such cases, immediately discuss them with your manager, employer or recruiting agent. If this issue is not resolved immediately, notify the Ministry of Labour, Migration and Employment of Population of the Republic of Tajikistan or other competent authority, your embassy, where you can be assisted.

If you are not satisfied with the response of these authorities, the matter can be referred to the local judiciary.

How to recognize violations of your labour rights?

Violations of your labour rights include any form of unfair or discriminatory treatment at work. Here are examples of labour rights violations:

  • Substitution of a contract
  • Excessive working hours
  • Delays in payment, as well as non-payment of wages and other benefits by the employer
  • Inappropriate salary deductions
  • Hazardous working conditions without adequate labour protection measures
  • Physical, financial and/or mental abuse, sexual harassment.

Always remember - legal residence and employment abroad is a guarantee of a safe life!
